{"id":22618,"date":"2019-06-27T14:00:56","date_gmt":"2019-06-27T04:00:56","guid":{"rendered":"http:\/\/wp.architecture.com.au\/news-media\/?p=22618"},"modified":"2019-06-28T12:03:58","modified_gmt":"2019-06-28T02:03:58","slug":"nsw-reforms-a-sensible-step-for-safety-time-to-act-nationally","status":"publish","type":"post","link":"https:\/\/wp.architecture.com.au\/news-media\/nsw-reforms-a-sensible-step-for-safety-time-to-act-nationally\/","title":{"rendered":"NSW reforms a sensible step for safety \u2013 time to act nationally"},"content":{"rendered":"\n<p>The Australian Institute of Architects has\nwelcomed more detail on the NSW Government response to building safety issues,\nlabelling it a belated but sensible step to maintain safety and public\nconfidence.<\/p>\n\n\n\n<p>The Institute\u2019s Immediate Past President, Clare Cousins, today said the Berejiklian Government\u2019s <a href=\"https:\/\/static.nsw.gov.au\/nsw-gov-au\/1561499024\/Building-Stronger-Foundations-Discussion-Paper.pdf\">Building Stronger Foundations<\/a> discussion paper requirement for registration of builders, designers, engineers \u2013 in addition to the existing requirements for architects \u2013 was long-awaited and important.<\/p>\n\n\n\n<p>\u2018The Institute has been calling for full\nregistration of people across the building industry for many years,\u2019 Ms Cousins\nsaid.<\/p>\n\n\n\n<p>\u2018We are pleased the NSW Government is finally making steps to action this measure. Now it is time for all other Australian states and territories to implement these protocols, and the full set of recommendations of last year\u2019s Shergold Weir report into building safety.<\/p>\n\n\n\n<p>\u2018These reforms are vital to protect public\nsafety and maintain public confidence in Australia\u2019s building protocols.\u2019<\/p>\n\n\n\n<p>The discussion paper of the NSW Government response\nproposes an industry-wide common law duty of care to owners and bodies\ncorporate, and would also create a regulatory system where builders and others could\nface deregistration if found to be negligent.<\/p>\n\n\n\n<p>It also includes builder declarations of\ncompliance with the Building Code of Australia, and a new building commissioner\nto oversee regulations.<\/p>\n\n\n\n<p>\u2018These vital safety measures must be\nimplemented as soon as possible,\u2019 Ms Cousins said. \u2018After the recent issues we\nhave seen with Mascot Towers and other incidents, the public needs to know\nthere is a robust and nationally consistent system in place to ensure safety\nfor people and their investments.\u2019<\/p>\n\n\n\n<p>NSW President of the Institute, Kathlyn Loseby\nadded: \u2018The Institute has been a leading voice in calling for increased\nbuilding safety measures in recent years and will be responding to the Government\u2019s\npaper\u2019.<\/p>\n\n\n\n<p>\u2018We welcome the impending appointment of a\nbuilding commissioner and the opportunity to work closely with the NSW\nGovernment to ensure these measures go far enough to protect our communities,\u2019\nshe said.<\/p>\n\n\n\n<p>\u2018The issues of self-certification,\ninappropriate risk allocation in contracts, and product substitution as a cost-saving\nmechanism also need to be addressed.\u2019 <\/p>\n\n\n\n<p>All architects are insured and are required to\nhave ongoing registration with state and territory bodies, following five years\nof tertiary education and two years\u2019 industry practice before taking a\nregistration exam. The Institute has called for a robust registration system like\nthis applied to all building practitioners including project managers, building\ndesigners and draughters.<\/p>\n\n\n\n<p>At the time of the last Building Ministers\u2019\nForum in March, only Tasmania had <a href=\"https:\/\/www.industry.gov.au\/sites\/default\/files\/2019-03\/building-confidence-report-implementation-plan.pdf\">implemented<\/a> the\nrecommendation to require registration of all practitioners in building design,\nconstruction and maintenance.<\/p>\n\n\n\n<p>The Institute is heartened there has been\ngreater implementation of the Building Ministers\u2019 Forum priority for\njurisdictions to create minimum controls to reduce conflicts of interest and\nincrease transparency between builders and surveyors, with complete\nimplementation in NSW, Victoria, South Australia and Tasmania.<\/p>\n\n\n\n<p>Ms Cousins said more action is needed across\njurisdictions for approved documentation to be prepared by registered\npractitioners, in accordance with the National Construction Code, which needs\nto be implemented in all states except Tasmania.<\/p>\n\n\n\n<p>\u2018Australia\u2019s vital building-safety system needs\nto be consistent across the entire country. All practitioners, be they\narchitects, builders, certifiers, surveyors, developers or engineers, must be\nheld accountable for the work they complete. Without surety on this our\ncommunities will pay the price,\u2019 she said.<\/p>\n\n\n\n<p>\u2018While we applaud the work done to date, work\nis still lagging on a national level.
